Liability Waiver & Release - Around the Wall Race

PLEASE READ CAREFULLY BEFORE REGISTERING

This is a legally binding agreement. By registering for Around the Wall Race, you are waiving certain legal rights, including the right to sue. Please read this entire document carefully.

If you do not understand any portion of this agreement, please seek legal counsel before signing.

1Acknowledgment of Risks

I acknowledge that participating in Around the Wall Race (the "Event") involves inherent and significant risks, including but not limited to:

Physical Injury or Death: Running 10 kilometers involves strenuous physical exertion that may result in serious injury, permanent disability, or death, including but not limited to: muscle strains, sprains, fractures, heat exhaustion, heat stroke, dehydration, cardiac arrest, heart attack, or other cardiovascular complications
Course Hazards: The Stanley Park Seawall course includes various hazards such as uneven pavement, cracks, potholes, debris, pedestrian and vehicle traffic, cyclists, wildlife, weather conditions (rain, wind, fog), and limited visibility in certain areas
Environmental Conditions: Exposure to potentially adverse weather conditions including rain, cold temperatures, heat, humidity, wind, and sun exposure that may result in hypothermia, hyperthermia, sunburn, or other weather-related illness
Collisions: Risk of collision with other participants, spectators, volunteers, vehicles, bicycles, stationary objects, or natural obstacles
Medical Emergencies: The possibility that medical assistance may not be immediately available or may be delayed due to course logistics and location
Personal Property: Risk of loss, theft, or damage to personal property including vehicles, clothing, electronic devices, and valuables

I understand that these risks may be caused by my own actions or inactions, the actions or inactions of others, the condition of the course, weather conditions, or the negligence of the Released Parties (as defined below).

I voluntarily assume all risks associated with participation in this Event, both known and unknown, even if arising from the negligence of the Released Parties.

2Health Certification

I certify that:

I am physically fit and sufficiently trained to participate in this Event
I have no medical condition that would prevent my safe participation in a 10-kilometer running race
I have consulted with a qualified medical professional regarding my ability to participate (or have knowingly chosen not to do so)
I am not under the influence of alcohol or any drugs that would impair my ability to safely participate
I will immediately notify event officials if I experience any symptoms of distress during the Event

Medical Disclaimer

Around the Wall Race strongly recommends that all participants obtain medical clearance from a licensed physician before participating in this Event, especially if you:

Have any pre-existing medical conditions
Are over 40 years of age and have not been regularly exercising
Have a family history of heart disease
Experience chest pain, dizziness, or shortness of breath during exercise

3Release and Waiver of Liability

In consideration of being permitted to participate in the Event, I, for myself and my heirs, executors, administrators, legal representatives, assignees, and successors in interest ("Releasors"), hereby:

RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the following parties (collectively, the "Released Parties"):

Around the Wall Race and its organizers, owners, and operators
Solefit and all event sponsors and partners
Stanley Park Ecology Society and other beneficiary organizations
The City of Vancouver and Vancouver Board of Parks and Recreation
All event volunteers, officials, staff, and contractors
All directors, officers, employees, agents, and representatives of any of the above entities
All vendors, suppliers, and service providers associated with the Event

FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, AND CAUSES OF ACTION whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my property, whether caused by:

The negligence of the Released Parties, or otherwise
Defective or dangerous conditions of the course or facilities
Failure to provide adequate safety measures or warnings
Any other circumstances, whether presently known or unknown

4Indemnification

I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all claims, damages, losses, costs, and expenses (including attorneys' fees) arising from or related to:

My participation in the Event
Any injury or damage I cause to any person or property
Any violation of these terms or the Rules of Competition
Any breach of my representations and warranties contained herein

5Media Release

I grant Around the Wall Race and its sponsors the irrevocable right and permission to use my name, voice, image, photograph, likeness, and biographical information in any medium (including but not limited to photographs, video, audio, social media, television, print, and online) for promotional, advertising, or commercial purposes without compensation or approval rights.

I understand that all photographs and recordings become the property of Around the Wall Race and may be used in perpetuity.

6Personal Property

I acknowledge that the Released Parties are not responsible for any loss, theft, or damage to my personal property, including vehicles, clothing, electronics, or valuables, before, during, or after the Event. I am solely responsible for the security of my belongings.

7Rules and Regulations

I agree to abide by all rules and regulations governing the Event, including:

The official Rules of Competition
Instructions from race officials, volunteers, and emergency personnel
All applicable laws and regulations
Course closure times and cut-off requirements

I understand that failure to comply may result in disqualification without refund.

8Cancellation and Changes

I understand and agree that:

The Event may be cancelled, postponed, or modified due to weather, public safety concerns, or other circumstances beyond the organizers' control
No refunds will be provided if the Event is cancelled or modified
The course, start time, or other Event details may change without prior notice
Registration fees are non-refundable and non-transferable

9Severability

If any provision of this agreement is found to be unenforceable or invalid, that provision shall be severed, and the remainder of this agreement shall continue in full force and effect.

10Governing Law and Jurisdiction

This agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein. I irrevocably submit to the exclusive jurisdiction of the courts of British Columbia.

11Minors (Participants Under 18)

For Participants Under 18 Years of Age

If the participant is under 18 years of age, the parent or legal guardian must complete this waiver on behalf of the minor participant.

By signing, the parent/guardian certifies that:

They have full legal authority to bind the minor to this agreement
They agree to all terms on behalf of themselves and the minor
They release the Released Parties from all claims that may arise from the minor's participation
They will indemnify the Released Parties for any claims arising from the minor's actions

ACKNOWLEDGMENT AND ACCEPTANCE

I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS.

I am aware that by registering for Around the Wall Race and checking the acknowledgment box, I am waiving certain legal rights, including the right to sue the Released Parties.

I understand that this is a binding legal agreement between myself and the Released Parties.

I sign this agreement voluntarily and of my own free will, with the full intention of being legally bound.

Electronic Signature

By completing the online registration process and checking the acknowledgment box, I agree that my electronic acceptance constitutes my legal signature and binding acceptance of all terms and conditions contained in this Liability Waiver and Release of Claims.
